ELIGIBILITY CRITERIA:

Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 are not eligible to use the Website. If your age is below 18 years you are prohibited to use/purchase/contract from/with this website.

Those who choose to access this website from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. We will deliver the products only within India and will not be liable for any claims relating to any products ordered from outside India. In case if any Indian states prohibit direct sale of merchandise from other states and require special documentation to effect such a sale without dual taxation, if we receive a order from such states or to be delivered to such states under such circumstances we retain the right to accept or reject the order.

Pricing and Payment:

Prices throughout the website are quoted in Indian Rupees (INR), and payment can only be accepted in Indian Rupees. Prices include VAT (Value Added Tax) / CST & Packing costs, Shipping cost and Transit Insurance.

Your order for purchase constitutes your offer which shall be subject to the terms and conditions as listed herein. We reserve the right to accept or reject your offer in part or in full. Our acceptance of your order will take place upon dispatch of the product(s) ordered. Dispatch of all the product(s) ordered, may or may not happen at the same time, in such a scenario that portion of the order which has been dispatched will be deemed to have been accepted by us and the balance would continue to be on offer to us and we reserve the right to accept or reject such balance order.

No act or omission of KMCL prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer. If you have provided us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm dispatch and therefore acceptance of the order.

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

The size (picture) of the jewellery has been enlarged 3 to 4 times so that you may see the intricacies of design with utmost clarity and this cannot be considered as the actual size of the piece of jewellery.

Delivery Schedule:

A tentative delivery time will be given along with the formal order confirmation email. The exact delivery date shall be provided as soon as your order is ready for dispatch.

YOUR OBLIGATIONS:

You have to provide true, accurate, current and complete information about yourself as prompted by KMCL registration form.
To maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current or if KMCL has reasonable grounds to suspect that such information is untrue, inaccurate, and not current or not in accordance with this User Agreement, we have the right to indefinitely suspend or terminate your order.
That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by KMCL for redelivery shall be claimed from you and you shall pay such cost.
You will provide authentic and true information in all instances where such information is requested of you. KMCL reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), KMCL has the right in its sole discretion to reject the order without prior intimation whatsoever.
That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
That before placing an order you shall check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale and invitation of offer included in the item's description.

Cancellation by KMCL

There may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional information or verification/s before accepting any order. We will inform you if the entire order or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit / debit card has been charged, the said amount will be reversed back in your Account.

Return Policy:

At www.kmcdiamonds.com we offer a simple return policy. If you are not entirely satisfied with your purchase, you may return the product/s bought from www.kmcdiamonds.com within 7 working days.
In the unlikely event that any merchandise you have ordered from us is not received in good condition, is damaged or defective, or if merchandise delivered is different from what you had ordered, you may return the merchandise unused, and in the same condition as you received in its original tamper proof packaging and product certificate, which will be thoroughly examined by KMCL, for a refund. Failing which return/ refund may not be possible.
You may drop us an email at Contact Us or call us at 044-28117463 / 28117464 (10:00 am to 6:00 pm India time - GMT + 05:30 hrs), and request a return within 2 days from delivery of the product to your shipping address. Please note we shall not entertain any request after 2 days from delivery of the product. All returns should be through India speed post, fully insured, must be accompanied by the original invoice, product certificate which is shipped along with the products. We will not be able to accept returns which are not accompanied by the relevant originals. All return costs and insurance charges shall be born by you. For the safety of your merchandise please avoid mentioning “Contains Jewellery” on the return package for fear of theft.
Before accepting delivery of the product/s, please ensure that the packaging has not been damaged or tampered with. If you believe that the merchandise is not in good condition, or if the packaging is tampered with or damaged, before accepting delivery of the goods, please refuse to take delivery of the package, and call our all-day helpdesk at 044-28117463 / 64 (10:00 am to 7:00 pm India time- GMT + 05:30 hrs) or e-mail us at kmclimited@kmcdiamonds.com, mentioning your order reference number. We shall make our best efforts to ensure that a replacement delivery is made to you at the earliest. If you have accepted the delivery, and then realized that the package is damaged, please feel free to get in touch with us within 2 days of receiving the package. We shall not entertain any request beyond 2 days.
While we shall make our best efforts to ensure that you are fully satisfied with any product/s you order from www.kmcdiamonds.com, however, we shall be unable to accept returns of any altered products.
In case of return of product/s the customer shall be liable to return all the product/s which were offered free as an offer on purchase of the original product/s
Incase of return, the merchandise has to be returned to KMCL insured by India post purely at your risk. KMCL is not in anyway responsible for any transit loss (or) transit damage.
After the merchandise is received by www.kmcdiamonds.com and subject to verification of the purchase and condition of products we shall process a refund within 7 business / working days of receipt of the product/s.
Refunds of payments charged to the Cardholder’s debit /credit card will only be credited back to the Cardholder’s debit / credit card account, which was used to pay for the original order. Please note that we shall not be responsible for any delays in credit to the Cardholder’s debit / credit card account as that is managed by the Cardholder’s issuing bank.
